KWG Resources reports it intends to appeal the decision of an Ontario Division Court regarding use of surface rights on its Ring of Fire mining claims.
On July 30, the court set aside a decision reached by the Ontario Mining and Lands Commissioner from last September that denied Cliffs Natural Resources an easement for a road in order to have land access to its Black Thor chromite deposit. The proposed road would run over some of the mining claims of a rival company, KWG Resources.
Cliffs appealed the mining commissioner’s ruling to the Division Court where it was dedicated that Cliffs didn’t require KWG’s consent for an easement.
The court found no evidence that a road would interfere with KWG’s exploration since the claims were staked with the aim of building a railway to a potential mine hundreds of kilometres away. The court delegated the easement decision to the Minister of Natural Resources and Forestry.
